TERMS AND CONDITIONS
Welcome to the SIR Corp. (“SIR”) sponsored Inspired Rewards loyalty program (the “SIR Loyalty Program”). By registering for an Account (defined below) you agree to be bound by these SIR Loyalty Program Terms & Conditions (“Terms”) and that you will comply with all applicable laws in the course of participating in the SIR Loyalty Program.
The membership is free of charge and no purchase is necessary to become a member.
By being a member of the SIR Loyalty Program you will earn points toward different tiers, services, events and much more offered and organized by Service Inspired Restaurants and it’s respective Canadian brands: Jack Astor’s Bar and Grill®, Scaddabush Italian Kitchen & Bar®, Reds®, Canyon Creek Chop House®, Loose Moose Tap & Grill®, Antler Room™, Duke’s Refresher® and Bar, Abbey’s Bakehouse® and Renegade Chicken™ (“SIR Participating Restaurants”).
The SIR Loyalty Program was created to recognize and reward our loyal guests. As part of the SIR Loyalty Program, members can earn SIR Loyalty Rewards, as explained below. The SIR Loyalty Program is a national program offered at all SIR Participating Restaurants in Canada and the United States. The SIR Loyalty Program is accessible through the SIR Loyalty Program app, namely “Inspired Rewards” (the “App”). These Terms apply to your participation in the SIR Loyalty Program and use of the App or inspiredrewards.com, and not to any other website, mobile app, product, service, or program offered by SIR.
Please read these Terms carefully, as they are a legal and binding agreement between you and SIR that apply to your use of the App and enrollment and participation in the SIR Loyalty Program. If you do not agree to these Terms, you are not permitted to participate in the SIR Loyalty Program.
In order to join and participate in the SIR Loyalty Program, you must warrant and represent that you are a natural person who is a Canadian resident, agree to be bound by these Terms, and be of legal drinking age in your province/territory/State of residence with a current and valid telephone number and email account. Corporations, partnerships, limited liability companies, trusts, or other legal entities are not permitted to enroll. Each SIR Loyalty Program member may have only one Account linked to a unique phone number. Employees and partners of SIR are eligible for membership but may be excluded from certain aspects or promotions at our sole discretion
Registration and Enrollment
By joining the SIR Loyalty Program on the App you represent that you meet the eligibility requirements as set out above and that you agree to these Terms.
Membership and its associated points and tiers are non-transferrable and limited to one membership account (each an “Account”) per person.
To enroll in the SIR Loyalty Program and begin earning points toward rewards (“Loyalty Rewards”), download the App from Google Play or the Apple Store, and follow the steps below.
Join through the Mobile App:
- Download the App from either Google Play or the Apple Store by searching for “Inspired Rewards” on your smartphone.
- Create an account in the App. by providing your first and last name, mobile phone number, email address, and create a password.
Once you enroll and have created an Account, regardless of method, you agree to (1) provide accurate and current information; and (2) maintain and promptly update your information to keep it accurate. You are responsible for maintaining the confidentiality of your Account information, including your password, and for all activity that occurs under your Account. You agree to notify SIR immediately of any unauthorized use of your Account information, or any other breach of security.
If any of the information you provide to SIR is not accurate or complete, we may prevent you from enrolling and/or cancel your membership in the SIR Loyalty Program. Each member may only have one SIR Loyalty Program Account. If SIR finds that you have created multiple SIR Loyalty Program Accounts, we may cancel all of your Accounts. Further, SIR may refuse to allow you to re-enroll in the SIR Loyalty Program. You may not sell, transfer, assign or share your Account.
SIR will use your contact information in order to keep in touch with you in the method(s) you selected when you enrolled. If your contact information changes, or if you wish to change your contact information or the method by which we send you messages (e.g. start having messages sent to your mobile phone number), please log onto the App and update your contact information or preferences.
How to Earn Points and Loyalty Rewards
As a benefit of being a member of the SIR Loyalty Program, you can earn and receive points that will count towards Loyalty Rewards. Members earn points for purchase and non-purchase behaviour, as outlined in the App. Loyalty Rewards accumulated under the SIR Loyalty Program are promotional and have no cash value. As you level up in tiers in the SIR Loyalty Program, you will unlock access to offers and SIR Loyalty Program elements, all of which can be changed at the discretion of SIR without prior notification. SIR reserves the right to limit the number of points a Member can earn in a single day.
You may earn and receive points toward Loyalty Rewards as follows:
By accumulating SIR Loyalty Program points and Loyalty Rewards you will earn various offers which you may redeem at SIR Participating Restaurants. Loyalty Rewards may not be used for gratuity, tax, private dining events, gift card purchases, or cash back. Loyalty Rewards will expire if a member has not received or exchanged any points for a period of at least one year. In such a case, SIR will send a notice to the member to the effect that the member’s inactivity will result in the expiry of the member’s points and specifying the applicable expiry date. Such notice of inactivity will be sent to the member at least 30 days, but not more than 60 days before the expiry of the points except as required by applicable law.
A Loyalty Reward may not be combined with any other non-Loyalty Program offer, discount or coupon. However, at SIR’s sole discretion on a promotion by promotion basis, it may be possible to combine and/or redeem multiple Loyalty Rewards to use at one time, depending on the conditions of each reward.
4th Visit Reward:
As a SIR Loyalty Program member you are entitled to a fixed amount off of your 4th visit tracked through the App. To earn this Loyalty Reward you must log three (3) visits to any SIR Participating Restaurant within a six (6) month period. The maximum amount of discount on your 4th visit is determined by 1) your loyalty level and 2) the average spend of your previous 3 visits.
Additional Loyalty Rewards Terms:
SIR has the right to verify the eligibility and/or legitimacy of any information that has been submitted in connection with the SIR Loyalty Program for any reason SIR deems necessary in its sole and absolute discretion and for the purposes of administering this SIR Loyalty Program. If the member fails to provide such proof to the satisfaction of SIR, it may, in its sole discretion, suspend, cancel, or refuse to allow you re-entry in the SIR Loyalty Program.
SIR has the right to change or modify these Terms or terminate the Program at any time, for any reason, except if such changes may affect the value of points already accumulated, the value of the rewards and/or the time for redemption. If we change any essential element of the Terms (including the nature of the goods or services provided under these Terms, the pricing thereof and the term of the contract), we will send you a written notice drawn up clearly and legibly, between the 90th and the 60th day preceding the coming into effect of the amendment, setting out the new clause only, or the amended clause and the clause as it read formerly, and the date of the coming into force of the amendment.
If we change any other of the Terms, we will send you a written notice drawn up clearly and legibly, at least 30 days preceding the coming into effect of the amendment, setting out exclusively the new clause, or the amended clause and the clause as it read formerly, the date of the coming into force of the amendment and providing that you may refuse the amendment and cancel the contract without cost, penalty or cancellation indemnity by sending SIR a notice to that effect no later than 30 days after the amendment comes into force, if the amendment entails an increase in your obligations or a reduction in our obligations.
Intellectual Property & Use of the App
The App and all content, information, and other materials featured, displayed, contained, and available on or through the App (collectively, the “Content“) is owned by or licensed to SIR and is protected by Canadian copyright, trademark, trade dress, patent, and/or other intellectual property laws. Subject to your compliance with these Terms, SIR grants you a personal, revocable, non-exclusive, non-transferable, limited right to access, use, display, and download this App for non-commercial purposes only. You may not otherwise copy, reproduce, distribute, transmit, display, perform, reproduce, publish, license, modify, create derivative works from, sell, or exploit, in whole or in part, this App or the Content.
You agree to use this App and the Content in accordance with these Terms and all applicable laws and regulations and any acceptable use policy we may establish or update from time to time. SIR may prohibit access, use, conduct and/or communications that SIR, in its sole discretion, deems to be harmful to this App, the Content, users, us, our brand, or any other person or entity, or that violates these Terms and/or applicable law.
All SIR Loyalty Program-related information is and remains the sole and exclusive property of SIR. The decisions of SIR with respect to all aspects of the SIR Loyalty Program are final and binding on all members without right of appeal, including without limitation, any decisions regarding the eligibility or disqualification of Qualifying Purchases or Loyalty Rewards. SIR also reserves the right to ‘unregister’ and make ineligible for use in connection with the Loyalty Program any Account that has been inactive for 18 consecutive months without notice to the member, unless otherwise required by law. An Account is considered inactive if no Qualifying Purchases or Loyalty Rewards have been earned or redeemed in connection with such Account (as determined by SIR in its sole and absolute discretion on the basis of its records). In the event an Account is unregistered or rendered ineligible, then all Qualifying Purchases and any Loyalty Rewards associated with such Account are revoked, nullified and voided.
Additionally, SIR may at any time, for any reason, and without notice or liability: (1) suspend or terminate operation of or access to the App or any portion thereof; (2) change, revise, or modify the App or any portion thereof; (3) interrupt the operation of the App or any portion thereof for maintenance and support; (4) impose limits on certain features and services, or restrict access to the App; and/or (5) terminate the authorization, rights, and license granted herein.
THE APP, THE CONTENT, THE SIR LOYALTY PROGRAM AND LOYALTY REWARDS ARE PROVIDED ON AN “AS IS”, AND “AS AVAILABLE” BASIS, AND SIR HEREBY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, ACCURACY, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. WITHOUT LIMITING THE FOREGOING, SIR DOES NOT GUARANTEE THAT THE APP OR CONTENT WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.
Limitations of Liability
To the maximum extent permitted by applicable law, by participating in the SIR Loyalty Program, the member hereby: (i) releases SIR, its affiliates, any other entity or person involved in the organization, administration or fulfillment of the SIR Loyalty Program and each of their respective officers, directors, shareholders, employees, representatives, agents, successors and assigns (collective the “Releasees”) from any loss, liability, claim, demand, damage or expense that arises in connection with participation in the SIR Loyalty Program; and (ii) agrees to indemnify, defend and hold harmless the Releasees from any loss, liability, claim, demand, damage or expense asserted by any entity or person relating in any way to a breach of any of the Terms. Without limiting the generality of the foregoing, the Releasees are not responsible for (i) lost, late, misdirected, delayed, incomplete or incompatible SIR Loyalty Program-related information; (ii) any failure of an Account, the Website, the App or any other SIR Loyalty Program-related hardware, software or other type of system; (iii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer online systems, servers, access providers, computer equipment or software; (iv) any injury or damage to Member’s or any other person’s computer, mobile device, tablet or other device related to or resulting from participating in the SIR Loyalty Program; and/or (v) any combination of the above.
Keeping in Touch with You
As a member of the SIR Loyalty Program, SIR will send to you informational and promotional messages to the contact information that you provide as a part of your registration. Communications may contain, but not be limited to, information advising you of improvements we make to the SIR Loyalty Program, new Loyalty Rewards you may earn, new SIR Participating Restaurants in the SIR Loyalty Program, new menu items you may want to try, and events happening at SIR Participating Restaurants. These communications may happen in the form of push notifications through the App and/or your Account email. You may unsubscribe from receiving commercial emails at any time using the unsubscribe mechanism included in these emails. After you unsubscribe, we may continue to send you emails related to the on-going administration and operation of the SIR Loyalty Program.
When you complete enrollment on the App, you are communicating with us electronically. We will communicate with you by email or by posting notices on the App.
In the event of any discrepancy or inconsistency between the English Terms and disclosures or other statements contained in any SIR Loyalty Program-related materials, including, but not limited to the Website, the App or the French version of these Terms, and/or point of sale, television, print or online advertising, the Terms of these English Terms shall prevail, govern and control to the fullest extent permitted by law.
For participants outside of the province of Quebec, the Terms, and all related matters shall be governed by the laws of the Province of Ontario, Canada and the applicable federal laws of Canada without regard to the conflicts of law provisions of any jurisdiction. You hereby irrevocably submit to the exclusive jurisdiction of the Courts of the Province of Ontario in the City of Toronto in relation to all disputes arising from or related to the Terms and any related matters.
For Members in the province of Quebec, the Terms and all related matters shall be governed by the Province of Quebec, Canada and the applicable federal laws of Canada without regard to the conflicts of law provisions of any jurisdiction. You hereby irrevocably submit to the exclusive jurisdiction of the Courts of the Province of Quebec in the City of Montreal in relation to all disputes arising from or related to the Terms and any related matters.
